Privacy policy
Welcome to Wishly! Because we need some of your data for your order, below you will find an overview of what exactly we collect, why we do so and how we keep your data safe.
1. Who are we?
We are Wishly. If you have any questions about your privacy, you can always reach us via our contact form.
- Company name: Wishly V.O.F.
- Address: Laurens Reaalstraat 40, 3531 GP Utrecht
- Chamber of Commerce (KVK) number: 42074649
2. What data do we collect and why?
We only ask for the data we really need. Below you can see what we collect and the legal reason (the 'legal basis') for it.
To process and deliver your order
We need your name, address, city, e-mail address and phone number. This lets us handle your payment, post the parcel and keep you informed about the delivery.
Legal basis: Performance of the contract.
To make your unique Wishly
We collect the specific texts and wishes that we program onto the Wishly's screen for you. Without this input we simply cannot make our product!
Legal basis: Performance of the contract
When you contact us
Do you send us a message with a question? Then we keep your contact details and your message so we can help you properly and, if needed, look back later at what we discussed.
Legal basis: Legitimate interest (providing good customer service).
To comply with the law
The Tax Authority requires us to keep proper records with invoice and payment data.
Legal basis: Legal obligation.
When you request example wishes
Do you request our example wishes? Then we use your email address to send them to you. If you tick the box to hear from us later as well, we'll send you an occasional email about Wishly. You can unsubscribe at any time.
Legal basis: Consent.
To improve the website and measure our ads
Do you give your consent through the cookie banner? Then we use Google Analytics to see how visitors use our website, and the Meta Pixel and TikTok Pixel to measure whether our ads work. This processes data about your visit, such as the pages you view, your device and (when you make a purchase) an encrypted version of your email address. You can withdraw your consent at any time through “Cookie settings” at the bottom of every page.
Legal basis: Consent.
3. How long do we keep your data?
We never keep your data longer than necessary:
Your personal wishes (the texts)
We keep these for as long as you have an active account with us. If you delete your account, or ask us to erase the texts, we will do so immediately. Please note: this is only possible after your order has been completed or cancelled, because we need the text during production.
Administration
We are required by the Tax Authority to keep financial data (such as invoices with your name on them) for 7 years.
4. Do we share your data with others?
We absolutely never sell your data to third parties. We only share it with a few regular partners who help us run our webshop and deliver your parcel:
- PostNL: to get your parcel safely to you or the recipient.
- fly.io: this is where our webshop and database run.
- Moneybird: for our bookkeeping and invoices.
- Zoho: for sending our emails.
- Cloudflare: to protect our forms against bots.
- Google (Analytics), Meta and TikTok: only if you give your consent, for website statistics and measuring our ads.
5. Where is your data stored?
Our webshop and database run on fly.io servers in Amsterdam, the Netherlands. The data we need for your order therefore stays within the European Economic Area (EEA).
Google, Meta and TikTok may also process data outside the EEA, for example in the United States. This only happens if you give your consent through the cookie banner, and on the basis of arrangements approved by the European Commission (such as the EU-US Data Privacy Framework and standard contractual clauses).
6. How do we protect your data?
Your privacy is important to us, so we protect your data well. Our website uses a secure connection (recognisable by the 'https' and the padlock in your address bar), so that the data you enter is sent encrypted. In addition, we use the professionally secured cloud infrastructure of fly.io to store our data (see the fly.io security documentationfor more technical details).
7. Cookies
We place necessary cookies to make the website work, for example to remember what's in your cart. We only place cookies for statistics (Google Analytics) and advertising (Meta and TikTok) if you give your consent. You can read more about this in our Cookie policy.
8. What are your rights?
You always stay in charge of your own data. You have the right to access, correct or delete your personal data. Just contact us and we'll take care of it for you.
Can't we really work it out together? Then you always have the right to lodge a complaint with the Dutch Data Protection Authority (Autoriteit Persoonsgegevens).
